Terms of Service

MarketYourIndie (the "Service") is operated by Juan Pablo Russo, an individual based in Argentina("MarketYourIndie", "we", "us"). These terms govern your use of the Service. By creating an account or using the Service, you agree to them. If you are using the Service on behalf of a studio, you confirm you are authorized to accept these terms for that studio.

The Service

MarketYourIndie gives indie developers tools to plan and track a game launch: marketing planning, financial estimates, market and competitor context, and legal document templates. The Service is offered as is and is actively evolving, so features may change, be added or be removed over time.

Beta service

The Service is currently offered as a beta / early-access product. It may contain bugs, change significantly, or have features added or removed with little notice, and we do not guarantee that it will always be available. We value your patience and any feedback you send while we improve it.

Your account

• You are responsible for keeping your login credentials safe and for activity under your account.
• You must provide accurate information and be at least 18 years old (or the age of majority where you live).
• Tell us promptly if you believe your account has been accessed without your permission.

Acceptable use

You agree not to:

• Break the law or infringe anyone's rights while using the Service.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the platform or its data.
• Resell or redistribute the Service, or scrape it in bulk, without our written permission.
• Upload content that is unlawful, malicious or that you do not have the right to use.

Your content

You keep all rights to the game and business data you put into the Service. You grant us only the limited permission needed to store and process that data so we can run the platform for you. You can export or delete your content as described in our Privacy Policy.

Our intellectual property

The Service itself, including its software, design, the content we create, the MarketYourIndie name and logo, and any aggregated or anonymized insights we derive, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service while these terms are in effect. You may not copy, modify, or create derivative works from the Service except as these terms allow.

Third-party services and Steam data

The Service relies on third-party providers for hosting, authentication and payments, and on data from third-party platforms. Their own terms and privacy practices may apply, and we are not responsible for third-party services we do not control.

MarketYourIndie is an independent tool. It is not affiliated with, endorsed by, or sponsored by Valve Corporation. Steam and the Steam logo are trademarks of Valve Corporation. Steam data shown in the Service is fetched from publicly available sources and may be incomplete or out of date.

Estimates are not professional advice

The revenue projections, pricing suggestions, market figures and legal templates in the Service are informational tools based on public data and common industry practice. They are estimates and starting points, not guarantees, and they are not financial, tax or legal advice. For decisions that matter, consult a qualified professional. Steam data is sourced from Valve and may be incomplete or out of date.

Subscriptions and payment

Some features may require a paid plan. Pricing and what each plan includes are shown at checkout. Fees are billed in advance for the billing period you select. Unless you cancel, paid plans renew automatically at the end of each period using your payment method on file, at the then-current price.

You can cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are non-refundable except where required by law. We will give you reasonable notice (at least 30 days where the law requires it) before any price change that affects your plan, and you can cancel before it takes effect. After cancellation you can export your data for a reasonable period before it is removed.

Disclaimers and liability

The Service is provided "as is" without warranties of any kind. We do not promise it will be uninterrupted or error free. To the maximum extent allowed by law, MarketYourIndie is not liable for indirect or consequential losses, or for lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Indemnification

To the extent permitted by law, you agree to indemnify and hold MarketYourIndie harmless from claims, damages and reasonable costs arising from your misuse of the Service, the content you upload, or your breach of these terms.

Termination

You can stop using the Service and delete your account at any time. We may suspend or close an account that breaks these terms or that puts the platform or other users at risk. If we close your account, we will give you a reasonable chance to export your data where possible.

Changes to these terms

We may update these terms as the Service grows. If a change is material, we will update the date above and let you know. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Argentina, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, it will be subject to the competent courts of Argentina. Nothing here removes mandatory consumer protections you may have where you live.

General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
